Terms of Service

These Terms of Service ("Terms") govern your use of ListRiver.com and the data products sold through it (the "Service"). The Service is provided by Snake River Enterprises LLC ("ListRiver," "we," "us"). By creating an account or placing an order, you agree to these Terms on behalf of the business you represent ("you").

1. Business customers only

The Service is sold only to registered business entities for business purposes. By creating an account you confirm that (a) you are at least 18 years old, (b) you are authorized to bind the business you name, and (c) that business is validly registered with a U.S. state. We may verify your business and may refuse or cancel any order we can't verify.

2. Your account

You are responsible for keeping your login credentials secure and for all activity under your account. Tell us promptly at [email protected] if you suspect unauthorized use.

3. The data

Our lists are compiled from public state business registry records and other sources, and may be supplemented with business credit data from SMBCredit.net. Public records change constantly and may contain errors. Data is provided "as is," without any warranty that it is complete, accurate or current. Each list includes the monthly refreshes described at purchase.

4. License to use the data

Lists are licensed for the buyer's own use only. You may not resell, sublicense, share, publish or give away any list you buy from ListRiver, or any part of it. You may use it only in connection with your own business operations. You confirm this at checkout, before you pay. Resale and redistribution are available only under a separate written license from ListRiver; contact us to ask about one.

When you pay for a list, we grant you a non-exclusive, non-transferable license to use the records in it for your own internal business purposes, including marketing to and communicating with the businesses listed. You may also use the records to carry out marketing or outreach on behalf of your own clients, as long as you do not give a client the list itself or any substantial part of it. Unless you hold a separate written resale license from ListRiver, you may not:

  • resell, sublicense, publish or give away the data, in whole or in substantial part, or use it to build a competing data product;
  • use the data for any purpose covered by the Fair Credit Reporting Act, including decisions about credit, insurance, employment or housing eligibility;
  • use the data to harass anyone, or for any unlawful, deceptive or fraudulent purpose; or
  • scrape, crawl or bulk-download from the website outside the ordering tools we provide.

5. Your responsibility for how you use the data

You are solely responsible for complying with all laws that apply to your use of the data, including CAN-SPAM, the Telephone Consumer Protection Act and do-not-call rules, and state privacy and marketing laws. Where a record contains a person's name (for example, a registered agent), you will treat it as business contact information only.

6. Orders, prices and payment

Prices are shown per record and the total is displayed before you pay. Payments are processed by Stripe; we don't store your full card or bank details. Prices may change, but changes never affect an order you've already paid for. Applicable taxes are your responsibility. Orders paid over time are also governed by our Financing Terms. A subscription (such as New Business Monthly) is charged each month to the card you paid with until you cancel, which you can do at any time on your private download page.

7. Refunds

Refunds are governed by our Refund Policy.

8. Accuracy corrections

If you believe information about your own business in our data is wrong, contact us through the contact form and we'll review and correct it.

9. Acceptable use of the website

Don't interfere with the Service, attempt to access accounts or data that aren't yours, or probe, scan or overload our systems. We may suspend accounts that violate these Terms.

10. Intellectual property

The website, software, compilation, formatting and enhancements of our data are owned by ListRiver and protected by law. Except for the data license in Section 4, no rights are granted to you.

11. Disclaimer of warranties

THE SERVICE AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

12. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LISTRIVER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS OR REVENUE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID FOR THE ORDER THAT GAVE RISE TO THE CLAIM.

13. Indemnification

You will defend and indemnify ListRiver against claims, losses and expenses (including reasonable attorneys' fees) arising from your use of the data or your violation of these Terms or of any law.

14. Changes to these Terms

We may update these Terms. The new version applies from its effective date; continuing to use the Service after that means you accept it. Changes don't affect orders already paid for.

15. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Wyoming, and you consent to their jurisdiction.

16. Trademarks

ListRiver and Pay-in-6™ are trademarks of Snake River Enterprises LLC. You may not use them in a way that suggests we endorse or are affiliated with you or your business. Other names and marks on the Service belong to their owners.
